Terms of Service

1. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use the Service. If you are between 13 and the age of majority, you must have a parent or guardian's consent to use the Service and agree to these Terms on your behalf.

2. Accounts

2.1 Account Creation

You may access the Service as a guest or by signing in with Google or Apple. You are responsible for maintaining the security of your device and any associated third-party accounts. You must provide accurate and complete information when creating or updating your profile.

2.2 Account Responsibilities

You are solely responsible for all activity that occurs through your account. Notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized access to your account.

3. In-App Purchases and Subscriptions

3.1 Purchases

The Service may offer virtual items, in-game currency, or premium features ("Virtual Items") for purchase through Apple App Store or Google Play. All purchases are processed by the respective platform's payment system and are subject to their terms and conditions.

3.2 Virtual Items

Virtual Items are digital content with no real-world monetary value. They are licensed to you on a limited, non-exclusive, non-transferable, revocable basis for personal, non-commercial use within the Service. Virtual Items cannot be redeemed for cash, refunded, or transferred between accounts except as required by applicable law or as facilitated through the supporting platform.

3.3 Pricing and Refunds

Prices for Virtual Items are displayed within the Service and may vary by region. All sales are final unless otherwise required by applicable law. Refund requests must be directed to the platform through which the purchase was made (Apple App Store or Google Play).

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Modify, reverse engineer, decompile, or disassemble any part of the Service.
• Use cheats, exploits, bots, automation software, or unauthorized third-party tools.
• Interfere with or disrupt the Service, its servers, or networks.
• Harass, abuse, or harm other users.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Upload or transmit viruses, malware, or other malicious code.
• Violate the terms of service of any third-party platform (Apple App Store, Google Play).

We reserve the right to suspend or terminate your access to the Service for any violation of these Terms, without prior notice.

5. Intellectual Property

5.1 Our Content

The Service and all content, features, and functionality — including but not limited to graphics, design, code, characters, artwork, music, sound effects, and trademarks — are owned by QupuTech or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

If you upload or submit content (e.g., a profile avatar), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content solely for the purpose of providing the Service to you. You represent that you have the right to grant this license.

5.3 Feedback

Any suggestions, ideas, or feedback you provide about the Service may be used by us without restriction or compensation.

6. Advertisements

The Service is supported by advertisements. By using the free version of the Service, you agree to the display of advertisements. You may purchase an ad-free experience through in-app purchase where available.

7. Third-Party Services

The Service may integrate with or link to third-party services including Google Sign-In, Apple Sign-In, and advertising networks. We do not control these services and are not responsible for their content, terms, or privacy practices. Your use of third-party services is governed by their respective terms.

8. Termination

8.1 By You

You may stop using the Service at any time. To delete your account and associated data, follow the instructions in our Account Deletion guide or contact us at [email protected].

8.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may lose access to Virtual Items, and no refund will be provided except as required by applicable law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUPUTECH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless QupuTech and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the People's Republic of China, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent court in the jurisdiction of QupuTech's principal place of business.

For users in the European Economic Area, United Kingdom, or other jurisdictions with mandatory consumer protection laws, nothing in these Terms limits your rights under local law.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or by other reasonable means. Your continued use of the Service after the effective date of any changes constitutes acceptance of the modified Terms.

14. App Store Provisions

14.1 Apple App Store

If you download the Service from the Apple App Store, you acknowledge that these Terms are between you and QupuTech, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple is a third-party beneficiary of these Terms.

14.2 Google Play

If you download the Service from Google Play, you acknowledge that these Terms are between you and QupuTech, not Google. Google is not responsible for the Service or its content.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
